Debt Collection at a cost you can afford

Are you experiencing cash flow problems as a result of others not paying your bills? 

We, at Walters & Barbary are aware of the difficulties that so many people experience. We have had many years of experience in dealing with debt recovery and are also aware that the cost of recovering a debt can sometimes be as much as the debt itself. However, we provide a debt recovery service, which we are sure, will be appealing to any business. We have recently reduced our charges again due to increased efficiency and technology.

Telephone, Email, Postal or Faxed Instructions

We appreciate that being in business doesn't leave you with much spare time and it is sometimes difficult to find time to attend a Solicitors' office to give full instructions.

To overcome this problem, we can take full instructions from you over the telephone or by email, post or fax as long as you provide us with the following details:

  • Name and address of debtor
  • Amount owing including invoice or account number
  • The date you submitted the last invoice or account
  • Your name and address
  • Send to us the initial fee of £25.00 plus V.A.T

Fixed Fee Charges

So that you can budget the amount to spend from the outset we are prepared to charge a standard fee in every case. These are as follows:

A Solicitor's Letter Demanding Payment for any Amount

It is surprising how often a threat of proceedings leads to payment of a debt. Our charge for this is £25.00 plus VAT. This includes receiving your instructions by phone, email, fax or post, writing to the debtor and reporting to you with the amount recovered or otherwise.

If Proceedings are Neccessary and no Defence is Served or Admission Filed

All work up to and entering Judgment,including the issue of a Summons and obtaining a County Court Judgment. Our charges and the Court fees, are as follows:

Claims over £50000.00 fees will be advised upon instructions.

N.B. Some of our fees and all Court costs are added to the Judgment Debt and are therefore recoverable from the debtor.

Enforcement of a Judgement

Where the debtor fails to pay after Judgment has been obtained and served upon him then it will be necessary to enforce the Judgment by one or more of various methods upon which we will advise you. The fees are as follows:

Where the Debt is Disputed

As soon as a Defence is received the claim becomes disputed and Judgment cannot be entered without the Court hearing the case.

Small Claims

Where the claim is less than £10,000.00 it will normally be heard in the Small Claims Court after the payment of additional Court costs (an allocation fee) of £400.00 (if the amount of the claim exceeds £1,500.00). In this event only very limited solicitors fees are recoverable by the winner but all Court fees and most travelling and witness expenses are. We can however represent you at any arbitration hearing for a modest fixed fee. Separate details of our Small Claims Court Service are available on request.

Claims Above £10,000.00

Where the amount involved in more than £10,000.00 and the debt is disputed then our charges are based on hourly rates and most of your legal costs are added to the debt. We are happy to give details and estimates in most cases after discussions about the case with you.

Conditions

All costs quoted are exclusive of V.A.T.

All costs, V.A.T. and Court fees are payable in advance at each stage of the proceedings.

Our fees for representation at an arbitration hearing are on the basis that the hearing takes place in the Truro County Court and do not last in excess of two hours. We reserve the right to charge hourly rates should the hearing be outside or require representation at hearings beyond the two hour limit.

Where we are involved on your behalf in the collection of monies payable by two or more installments a fee of ten percent of the monies collected will be charged in addition to any other standard fee that may be chargeable.
